1. ELIGIBILITY

3. SANCTIONED, RESTRICTED AND/OR OUTLAWED PARTIES

You may not access or use our services if:
a) You are located in, under the control of, or a national or resident of any country that is subject to applicable sanctions or embargoes administered or enforced by:

  • The Australian Government Department of Foreign Affairs and Trade (DFAT) under the Autonomous Sanctions Act 2011 and Autonomous Sanctions Regulations 2011

  • The U.S. Department of Treasury's Office of Foreign Assets Control (OFAC)

  • The U.K. Office of Financial Sanctions Implementation (OFSI) under the Sanctions and Anti-Money Laundering Act 2018


b) You are listed on, owned or controlled by, or acting on behalf of anyone listed on:

  • The Consolidated List maintained by the Australian Government Department of Foreign Affairs and Trade

  • The U.S. Treasury Department's Specially Designated Nationals and Blocked Persons List (SDN List) or other OFAC sanctions lists

  • The U.K. Consolidated List of Financial Sanctions Targets maintained by OFSI

  • Any other restricted party lists maintained by the Australian, U.S., or U.K. governments


c) You are a member of, affiliated with, or acting on behalf of:

  • Any organisation listed as a terrorist organisation under Australia's Criminal Code Act 1995 (Cth), Division 102

  • Any organisation designated as a Foreign Terrorist Organization by the U.S. Secretary of State under section 219 of the Immigration and Nationality Act

  • Any organisation proscribed as a terrorist organisation under the U.K. Terrorism Act 2000

  • Any criminal organisation as defined under:

    • Australia's Criminal Code Act 1995 (Cth)

    • The U.S. Racketeer Influenced and Corrupt Organizations (RICO) Act

    • The U.K. Serious Crime Act 2015


d) You are:

  • Subject to any denial orders or other restrictions by relevant defence trade control authorities

  • Prohibited from receiving defence articles or services under applicable laws and regulations

  • Located in any country subject to arms embargo or defence trade restrictions

  • Listed on any government register of prohibited or debarred parties


e) You are engaged in:

  • Any activities that would violate applicable sanctions laws and regulations

  • Any activities prohibited under defence trade control laws and regulations

  • Any criminal activities as defined by applicable Australian, U.S., or U.K. law

  • Any unauthorised transfer or disclosure of defence-related information


You represent and warrant that you are not subject to these restrictions and will immediately notify us if you become subject to any of these restrictions. We maintain the right to verify your status against any relevant government lists or registers. We reserve the right to terminate access immediately and without notice to users who violate or are suspected of violating these restrictions.

For the purposes of these Terms, references to laws and regulations include any amendments, updates, or successor legislation as may be enacted from time to time.

4. TERMINATION OF USE
We may at our sole discretion suspend or terminate your access to our services at any time, with or without notice for any reason or no reason at all. We also reserve the right to modify or discontinue the services at any time without notice to you. We will have no liability whatsoever on account of any change to the services or any suspension or termination of your access to or use of the services.

8. ARTIFICIAL INTELLIGENCE RESTRICTION
You may not use automated bots to access, scan, scrape, data mine, copy, or use the materials or content on this website for developing, training, fine-tuning, or otherwise contributing to or improving a machine learning model or artificial intelligence (AI) system without our express written permission.

IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICES.

12. GOVERNING LAW
These Terms will be governed by the laws of Australia. You agree to submit to the jurisdiction of courts located within Canberra, Australian Capital Territory, for the purpose of litigating all disputes.

We reserve the right to make modifications to these Terms at any time. Revised versions of these Terms will be posted to this website. Unless otherwise specified, any modifications to the Terms will take effect immediately upon posting.
